RAYMOND GARCES CHANGE OF PLEA

Las Cruces–Raymond Garces appeared in district court today and pled no contest to a charge of Criminal Trespassing. Allegedly, on January 1, 2014, Garces and several others forcibly entered the home of Joe Torrez at 634 King James.

Witnesses from inside the home stated that Garces did in fact enter the home along with Leonard Calvillo and Nathan Avalos but repeatedly attempted to convince them to vacate the property. A thorough investigation made it increasingly clear that a conviction on any other charges was very unlikely.

Senior Trial Attorney Daniel Sewell stated, “This is just a result of the evidence we had for Mr. Garces, it is very different from the evidence we have for the other defendants in this case.”

Judge Fernando Macias delayed sentencing and ordered a pre-sentence report to be completed by the adult probation office prior to rendering his decision.

Dona Ana County Sheriff’s Department Investigators worked tirelessly on all aspects of the investigation and fully support the decision of the District Attorney’s Office for the charge against Mr. Garces.
Trial for the remaining defendants in this case are pending.
