Las Cruces—Destiny Miller, 17, has been indicted on (4) counts of Criminal Sexual Penetration (child under 13 years of age); (1) count of Criminal Sexual Contact of a minor and (1) count of Sexual Exploitation of Children.
Miller engaged in pornographic acts with a female child under 13 years of age and distributed the photos sometime between January 2011-February 2015.
Homeland Security agents and the Doña Ana County Sheriff’s Department were central to the investigation of this case. Deputy District Attorney Cynthia Clark will be representing the victim and the State of New Mexico in the prosecution of Miller.
By filing a notice of intent to seek adult sanctions in juvenile court the DA‘s office is pursuing adult sentencing. If convicted and sentenced as an adult Miller could face up to 88 years imprisonment. If a jury finds her amenable as a juvenile, the maximum disposition is 2 years commitment to a juvenile institution with extensions up to the age of 21.
A trial date is pending.
